1. Acceptance of These Terms

These Terms of Service ("Terms") form a legally binding agreement between you and Oath ("Oath", "we", "us", or "our") governing your use of the Oath mobile application for iOS and any related services and websites (collectively, the "App" or "Service").

By downloading, installing, accessing, or using the App, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference. If you do not agree, do not download or use the App. These Terms apply to everyone who uses the App, including those on a free trial and active Oath+ subscribers.

2. Eligibility

You must be at least 13 years old to use the App. If you are under the age of majority where you live (typically 18), you may only use the App with the involvement and consent of a parent or legal guardian who agrees to these Terms on your behalf. By using the App, you represent that you meet these requirements and have the legal capacity to enter into this agreement.

3. Apple App Store Terms

The App is distributed through the Apple App Store, and the following additional terms apply. They are required by Apple and, in the event of any conflict with the rest of these Terms in relation to your use via the App Store, these App Store terms control to the extent of that conflict:

  • This agreement is between you and Oath only, and not with Apple Inc. ("Apple"). Oath, not Apple, is solely responsible for the App and its content.
  • Your licence to use the App is a non-transferable licence to use the App on any Apple-branded device that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
  • Apple has no obligation to furnish any maintenance or support services for the App.
  • To the maximum extent permitted by law, Apple has no warranty obligation with respect to the App. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any) you paid for the App; subject to that, Apple has no other warranty obligation, and any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to a warranty are Oath's responsibility, not Apple's.
  • Oath, not Apple, is responsible for addressing any claims by you or a third party relating to the App, including product-liability claims, claims that the App fails to conform to legal or regulatory requirements, and claims under consumer-protection or similar legislation.
  • In the event of any third-party claim that the App or your use of it infringes that third party's intellectual property rights, Oath (not Apple) is solely responsible for the investigation, defence, settlement, and discharge of that claim.
  • You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
  • You must comply with any applicable third-party terms when using the App (for example, your wireless data-plan agreement).
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

4. Licence to Use the App

Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable licence to download and use the App on Apple devices you own or control, for your own personal, non-commercial use. You may not, and may not allow anyone else to:

  • copy, modify, adapt, translate, sell, rent, lease, or distribute the App or any part of it;
  • reverse-engineer, decompile, or disassemble the App, or attempt to derive its source code, except to the limited extent this restriction is prohibited by applicable law;
  • remove, obscure, or alter any proprietary notices;
  • use the App for any commercial purpose without our prior written consent;
  • use bots, scrapers, or other automated means to access or interact with the App, or attempt to bypass usage limits or security controls; or
  • attempt to gain unauthorised access to the App, our systems, or other users' data.

All rights not expressly granted are reserved. This licence does not transfer any ownership in the App to you.

5. Your Account

You create an account using Apple Sign In. You agree to provide accurate information, not to impersonate anyone, to keep your Apple ID secure, and to be responsible for all activity under your account. We do not manage your authentication credentials — those are handled by Apple. An account is required to use the App. You must notify us promptly of any unauthorised use of your account. We may suspend or terminate accounts that violate these Terms, that are fraudulent, or where required by law.

6. Subscription & Billing (Oath+)

Oath is a subscription application. After any free trial, an active Oath+ subscription is required to use the App; without an active subscription, the App's features are not accessible. A single Oath+ plan unlocks all features — there are no separate tiers or additional in-app purchases.

Pricing

Current Oath+ pricing (as displayed in the App Store at the time of purchase, where it always controls):

  • Monthly: £4.99 per month
  • Annual: £39.99 per year (approximately £3.33/month)

Prices vary by region and are shown in your local currency in the App Store, inclusive of applicable taxes where required.

Billing & auto-renewal

Subscriptions are sold and billed by Apple through your Apple ID, not by us. Payment is charged on confirmation of purchase. Subscriptions renew automatically and continue until cancelled; auto-renew must be turned off at least 24 hours before the end of the current period to avoid the next charge. Your Apple ID is charged for renewal within 24 hours before the end of the current period. You can manage and cancel your subscription in your Apple ID settings. We never receive or store your payment-card details.

Price changes

We may change subscription prices. Where required, Apple and/or we will give you advance notice, and in the cases required by law your continued subscription after the change takes effect constitutes acceptance of the new price. You can cancel before a change takes effect.

7. Free Trial

We may offer a free trial (for example, a 3-day trial on the annual plan) to new subscribers. Free trials are limited to one per Apple ID and are subject to change or withdrawal at any time. Unless you cancel before the trial ends, your subscription automatically converts to a paid subscription and your Apple ID is charged at the then-current price. If you have previously used a trial, you may not be eligible for another.

8. Cancellation & Refunds

You may cancel at any time in iOS Settings → [your name] → Subscriptions → Oath. Cancellation stops future renewals; you keep access until the end of the current billing period. Because subscriptions are sold by Apple, all billing and refund requests are handled by Apple via reportaproblem.apple.com, subject to Apple's policies. We generally do not provide refunds for partial periods, except where required by law.

UK/EU consumers: you normally have a 14-day right to cancel a purchase of digital content. By starting your subscription and accessing Oath+ immediately, you request that the service begins during the cancellation period and acknowledge that your statutory right to cancel may be lost once the digital content has been supplied. This does not affect your other statutory rights.

9. Acceptable Use

You agree not to:

  • attempt to deceive, game, or circumvent the AI photo-validation system, including by submitting pre-taken photos, screenshots, photos of screens, photos of photos, AI-generated images, or any content that misrepresents what you actually did;
  • submit unlawful, infringing, harmful, hateful, harassing, obscene, or sexually explicit content, or content depicting other people without their consent;
  • use the App to violate any law or the rights of others;
  • interfere with, disrupt, overload, or compromise the App or our systems, or attempt to bypass rate limits or security measures;
  • use automated means (bots, scrapers, crawlers) to access the App; or
  • reverse-engineer or attempt to extract source code or our prompts/models except as permitted by law.

Violating these rules may result in immediate suspension or termination of your account, without notice or refund, at our reasonable discretion.

10. AI Photo Validation

Oath uses AI to assess photo proof. You acknowledge and agree that:

  • AI is probabilistic and not guaranteed to be accurate. It may return incorrect results (false passes or false fails). It is provided on a best-effort basis.
  • A manual alternative is always available. If a result is wrong, you can mark a task complete using manual validation, regardless of AI attempt limits, and you may contact us for review at hello@oath-app.com. We consider such requests in good faith but do not guarantee any particular outcome.
  • Fair-use limits apply. AI validation is limited to a number of attempts per item per day and a number of distinct items per day; these limits exist to keep the service available and to prevent abuse, and may change.
  • What is sent for analysis: when you submit a photo, the image together with the title and any description of the relevant habit or to-do is processed by our AI provider, as described in our Privacy Policy. The photo is not stored by us afterwards.
  • We are not liable for the consequences of any validation result, including any effect on your streak, milestones, or account standing.

11. Your Content & Photos

You retain ownership of the content you create in the App — your habit and to-do titles, descriptions, notes, and any photos you capture ("Your Content"). You grant us a limited, worldwide, royalty-free licence to host, store, process, and transmit Your Content solely to operate and provide the Service to you (including transmitting a photo for AI validation). We claim no ownership of Your Content.

You represent and warrant that you have all rights necessary to submit Your Content and that doing so does not violate any law or the rights of any third party. You are solely responsible for what you photograph. Do not capture or submit images of other people, private property, or anything else without the necessary consent or rights, and do not submit anything unlawful.

12. Health, Fitness & Assumption of Risk

Oath is a productivity and accountability tool, not a health, medical, fitness, or mental-health service. It does not provide medical, psychological, nutritional, fitness, or professional advice, and nothing in the App should be relied on as such.

You may use Oath to commit to activities you choose, which can include physical exercise, dietary changes, cold exposure, and similar habits. You undertake any such activity entirely at your own risk. Consult a qualified professional (such as a physician) before beginning any new exercise, diet, or wellness regimen, and stop and seek help if you feel unwell. To the fullest extent permitted by law, you assume all risks associated with the habits and activities you choose to pursue, and Oath is not responsible or liable for any injury, illness, loss, or harm resulting from them.

Oath is also not a crisis or mental-health resource. If you are struggling or in crisis, contact a qualified professional or your local emergency services.

13. Intellectual Property

The App — including the name "Oath", the flame logo, and all software, design, text, graphics, and other materials we provide (excluding Your Content) — is owned by or licensed to us and protected by intellectual-property laws. You may not use our branding, name, or logo without our prior written permission.

14. Privacy

Our Privacy Policy explains how we handle your personal data and is incorporated into these Terms. By using the App, you agree to that handling.

15. Third-Party Services

The App relies on third-party services, including Apple (distribution, sign-in, billing, notifications), Supabase (backend and data storage), OpenAI (AI photo analysis), and RevenueCat (subscription management). Your use of those services may be subject to their own terms and privacy policies. We are not responsible for third-party services, their availability, or their acts or omissions, and we do not control them.

16. Disclaimers

To the fullest extent permitted by law, the App is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, satisfactory quality, fitness for a particular purpose, and non-infringement. Without limiting that, we do not warrant that:

  • the App will be uninterrupted, timely, secure, or error-free;
  • AI validation results, streak data, or other outputs will be accurate, complete, or reliable;
  • any data, streak, note, or other content will be preserved without loss; or
  • the App will meet your expectations or achieve any particular result, outcome, or goal.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you. Nothing in these Terms excludes statutory rights that cannot lawfully be excluded.

17. Limitation of Liability

To the fullest extent permitted by law, Oath and its owners, operators, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, streaks, or opportunities, or for emotional distress, arising out of or relating to your use of (or inability to use) the App, whether based in contract, tort, or otherwise, even if advised of the possibility of such damages.

To the fullest extent permitted by law, our total aggregate liability for all claims arising out of or relating to the App or these Terms will not exceed the greater of (a) the total amount you paid us (or via Apple for the App) in the 12 months before the event giving rise to the claim, or (b) £100.

Nothing in these Terms limits or excludes our liability for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; or any other liability that cannot be limited or excluded under applicable law. If you are a consumer, these limits do not affect your mandatory statutory rights.

18. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Oath and its owners and operators from and against any claims, damages, liabilities, losses, and reasonable costs (including legal fees) arising out of or related to: (a) Your Content, including any photo you capture or submit; (b) your use or misuse of the App; (c) your violation of these Terms or any law; or (d) your infringement of the rights of any third party. This Section does not apply to the extent a claim arises from our own breach of these Terms or our negligence, and nothing in it requires a consumer to indemnify us beyond what is permitted by applicable law.

19. Termination

You may stop using the App at any time and delete your account in Settings → Delete Account (a two-step confirmation), which permanently removes your data as described in our Privacy Policy. We may suspend or terminate your access at any time, with or without notice, if you breach these Terms, if required by law, or to protect the Service or other users. Sections that by their nature should survive termination — including Sections 11, 13, 16, 17, 18, 21, and 22 — will survive.

20. Changes to These Terms

We may update these Terms from time to time. When changes are material, we will update the "Last updated" date and, where appropriate, notify you in the App or by email. Changes take effect when posted (or on any later stated date). Your continued use of the App after that constitutes acceptance. If you do not agree, you must stop using the App and may cancel any subscription before the changes take effect.

21. Governing Law & Disputes

These Terms are governed by the laws of England and Wales. Subject to the consumer rights below, you and we submit to the exclusive jurisdiction of the courts of England and Wales for any dispute arising out of or relating to these Terms or the App.

If you are a consumer, nothing here deprives you of the protection of mandatory consumer-protection laws of your country of residence, and you may bring proceedings in your local courts. EU consumers may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

To the extent permitted by applicable law, any dispute will be resolved on an individual basis, and you and we waive any right to bring or participate in a class, collective, or representative action. This waiver does not apply where prohibited by law and does not limit any non-waivable consumer rights.

22. General

  • Entire agreement: these Terms and the documents referenced in them are the entire agreement between you and us regarding the App and supersede any prior agreements.
  • Severability: if any provision is held unenforceable, the rest remains in effect, and the unenforceable provision will be modified to the minimum extent necessary.
  • No waiver: our failure to enforce a provision is not a waiver of it.
  • Assignment: you may not assign these Terms without our consent; we may assign them to an affiliate or in connection with a merger, acquisition, or sale of assets.
  • Force majeure: we are not liable for delays or failures caused by events beyond our reasonable control.
  • Notices: we may provide notices via the App or the email associated with your account.
