1. Acceptance of Terms
These Terms of Service ("Terms") are a legally binding agreement between you and Oath ("we", "us", "our") governing your use of the Oath mobile application and any associated services (collectively, the "App").
By downloading, installing, or using the App, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the App.
These Terms apply to all users of the App, including those on a free trial and active Oath+ subscribers.
2. Eligibility
You must be at least 13 years of age to use the App. If you are between 13 and 18 years of age (or the age of majority in your jurisdiction), you represent that a parent or legal guardian has reviewed and consented to these Terms on your behalf.
By using the App, you represent and warrant that you meet these age requirements and that you have the legal capacity to enter into a binding agreement.
3. App Licence
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to download and use the App on devices you own or control, solely for your personal, non-commercial purposes.
You may not:
- Copy, modify, distribute, sell, or sublicence the App or any part of it
- Reverse-engineer, decompile, or disassemble the App
- Remove or alter any copyright, trademark, or proprietary notices
- Use the App for any commercial purpose without our prior written consent
- Use automated tools, bots, or scripts to access or interact with the App
- Attempt to gain unauthorised access to our systems or networks
This licence does not transfer any ownership rights to you. All rights not expressly granted are reserved by us.
4. Your Account
To access social features and cloud sync, you must create an account using Apple Sign In. You agree to:
- Provide accurate registration information (including choosing a unique username)
- Not impersonate another person or use a misleading username
- Keep your Apple ID secure — your Oath account is linked to your Apple ID, and we do not manage your authentication credentials
- Notify us immediately if you suspect unauthorised use of your account
- Be responsible for all activity that occurs under your account
Many core features of the App (creating habits, todos, tracking completions, and streaks) are available without creating an account. An account is required for social features, cloud sync, and AI photo validation.
We reserve the right to suspend or terminate accounts that violate these Terms, contain impersonation, or are found to be fraudulent.
5. Subscription & Billing (Oath+)
Oath is a subscription-based application. After a free trial period (see Section 6), an active Oath+ subscription is required to use the App. Without a subscription, access to the App's features is restricted.
An Oath+ subscription includes:
- Unlimited habit and todo creation (with all schedule types, priorities, and validation modes)
- AI photo validation with up to 3 attempts per item per day
- Manual validation (self-attestation) as an alternative to AI validation
- Time-window validation
- Streak tracking with weekly progress, longest streak, and milestone celebrations
- Weekly targets and daily reps for habits
- Recurring todos
- Social features: friends, leaderboard, activity feed, and friend activity photos
- Cloud sync across sessions
- Habit memory photos (permanent personal archive)
- Push notifications and per-habit reminders
Pricing
Current Oath+ pricing (as displayed in the App Store at the time of purchase):
- Monthly plan: £4.99 per month
- Yearly plan: £39.99 per year (approximately £3.33/month)
Prices may vary by region and are displayed in your local currency in the App Store. All prices are inclusive of applicable taxes where required by law.
Billing & Auto-Renewal
Subscriptions are billed through the Apple App Store. Payment is charged to your Apple ID at confirmation of purchase. Your subscription automatically renews at the end of each billing period (monthly or yearly) unless cancelled at least 24 hours before the renewal date. You authorise Apple to charge your payment method on file automatically at the start of each renewal period.
We do not have access to your payment card details — billing is handled entirely by Apple.
Price Changes
We may change subscription prices from time to time. We will provide at least 30 days' notice of any price change via email and/or an in-app notification. If you do not cancel before the price change takes effect, your continued subscription constitutes acceptance of the new price.
6. Free Trial
We may offer a free trial period for new Oath+ subscribers. The following conditions apply:
- Free trials are available to new subscribers only — one trial per Apple ID.
- At the end of the free trial, your subscription will automatically convert to a paid subscription and you will be billed at the applicable rate unless you cancel before the trial ends.
- The duration and availability of free trials may vary and are subject to change at any time.
- If you have previously had a free trial for Oath+, you are not eligible for a further free trial.
7. Cancellation & Refunds
How to cancel
You may cancel your Oath+ subscription at any time through:
- iOS: Settings → [Your Name] → Subscriptions → Oath → Cancel Subscription
Cancellation takes effect at the end of the current billing period. You will retain access to Oath+ features until the period ends. We do not offer partial-period refunds for unused time after cancellation, except as required by law.
Refunds
All subscription purchases are processed by Apple. Refund requests must be submitted directly to Apple via reportaproblem.apple.com.
UK Consumer Rights: Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you may have the right to cancel within 14 days of your initial purchase. However, by subscribing and beginning to access Oath+ digital content, you acknowledge and consent to the immediate commencement of the service, and you understand that your right of withdrawal may be lost once the digital content has been accessed. This does not affect your statutory rights.
8. User Conduct
By using the App, you agree not to:
- Submit false, misleading, or fraudulent information in your account profile
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity
- Upload, submit, or share content that is illegal, offensive, obscene, defamatory, or that infringes the intellectual property rights of others
- Deliberately circumvent or attempt to deceive the AI photo verification system, including by submitting pre-taken photos, screenshots, images of images, or other non-live content
- Harass, bully, threaten, or intimidate other users
- Use the App for any unlawful purpose or in violation of any applicable law or regulation
- Attempt to interfere with, disrupt, or compromise the security or integrity of the App or our servers
- Use any automated means (bots, scrapers, crawlers) to access or interact with the App
- Attempt to bypass rate limits or abuse the AI validation service
Violations of these rules may result in immediate suspension or permanent termination of your account, at our sole discretion, without notice or refund.
9. AI Photo Validation
Oath includes AI-powered photo proof verification. Please understand the following:
- AI is probabilistic, not guaranteed. Our AI validation system is designed to make reasonable assessments of photo evidence, but it is not infallible. It may occasionally produce incorrect results (false positives or false negatives).
- Manual override available. If the AI rejects a photo you believe is valid, you may use the manual validation (self-attestation) feature as an alternative. Manual validation is always available regardless of AI attempt limits.
- No liability for incorrect validations. We accept no liability for the consequences of incorrect AI validation outcomes, including any impact on your streak count or account standing.
- Data sent to AI. When you submit a photo for validation, the compressed image along with the title and description of your habit or todo is sent to OpenAI's API for analysis. OpenAI does not use API submissions to train their models.
- Attempt limits. AI verification is limited to 3 attempts per item per day. This limit exists to prevent abuse and encourage genuine photo submissions.
- Disputes. If you believe an AI validation result was clearly incorrect and manual validation is not satisfactory, you may contact us at hello@oath-app.com. We will consider disputes in good faith but cannot guarantee any particular outcome.
- No cheating. Deliberately submitting misleading evidence (e.g. photos of screens, recycled photos, images unrelated to the habit) constitutes a breach of these Terms and may result in account suspension.
10. Social Features
Oath includes social features, including a friends list, activity feed, leaderboard, and optional photo sharing. By using these features, you agree to:
- Only connect with people you know or who have consented to connecting with you
- Treat other users with respect — harassment, bullying, threatening behaviour, or offensive conduct is strictly prohibited
- Understand that the following data is visible to your accepted friends: your username, display name, current streak, longest streak, daily completion count (number completed vs. total scheduled), and any photos you optionally choose to share
- Understand that your streak and rank may be visible on the leaderboard to all your accepted friends
- Not collect or harvest other users' personal information
We reserve the right to remove any user-generated content (including usernames or profile information) and to suspend or ban users who violate these conduct standards, at our sole discretion and without prior notice.
11. Photos & Memories
The App allows you to capture and store photos in the following ways:
- AI validation photos: Submitted for proof verification. These are processed by our AI service and are not permanently stored on our servers after validation is complete.
- Habit memory photos: Upon successful validation, proof photos may be saved as permanent personal memories, stored privately in your account. Only you can view your habit memories. These are retained until you delete your account.
- Friend activity photos: You may optionally share a proof photo with your accepted friends. Shared photos are automatically deleted after 48 hours.
By capturing and submitting photos through the App, you represent that you have the right to use those images and that they do not infringe on any third party's rights. You grant us a limited licence to store, transmit, and process your photos solely for the purposes described above.
12. Intellectual Property
Our property
The App, including its name "Oath", the flame logo, all design elements, code, graphics, text, and other content we create, are owned by or licenced to us and are protected by copyright, trademark, and other intellectual property laws. You may not use our branding, name, or logo without our prior written consent.
Your content
Content you create within the App — including your habit titles, descriptions, and proof photos — remains your property. By using the App, you grant us a limited licence to store, process, and display your content solely for the purpose of providing the App's features (including AI validation, habit memory storage, and optional friend sharing).
We make no claim of ownership over your personal habit data, photos, or any content you create.
13. Privacy
Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you consent to our collection and use of your data as described in the Privacy Policy.
14. Disclaimers
The App is provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied, including but not limited to:
- Warranties of merchantability, fitness for a particular purpose, or non-infringement
- Guarantees of uninterrupted, error-free, or secure access to the App
- Guarantees regarding the accuracy, completeness, or reliability of AI validation results
- Guarantees of streak data integrity in the event of server errors, data loss, or technical failures
- Guarantees that habit memory photos or other stored data will be preserved indefinitely
Not a health or wellness tool. Oath is a productivity and accountability application. It is not a medical device, mental health application, or therapeutic tool. Nothing in the App constitutes medical, psychological, or professional advice. If you have concerns about your mental health or wellbeing, please consult a qualified professional.
Some jurisdictions do not allow the exclusion of implied warranties, so some of the above may not apply to you.
15. Limitation of Liability
To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the App, including but not limited to:
- Loss of data, streaks, habit memories, photos, or account access
- Loss of profits or business opportunities
- Emotional distress arising from broken streaks or incorrect AI validations
- Any conduct or content of other users
- Any unauthorised access to or alteration of your data
Our total aggregate liability to you for any claims arising from these Terms or the App shall not exceed the greater of: (a) the total amount paid by you to us in the 12 months immediately preceding the claim, or (b) £10.
UK Consumer Rights: Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under English law. Your statutory rights as a consumer are not affected.
16. Termination
We may suspend or terminate your access to the App at any time and without prior notice if we reasonably believe you have violated these Terms or if required for legal reasons.
You may terminate your use of the App at any time by deleting your account (Profile → Delete Account) and uninstalling the App. Account deletion requires a two-step confirmation and permanently removes all your data from our systems in accordance with our Privacy Policy.
Upon termination for any reason, all rights granted to you under these Terms cease immediately. Provisions that by their nature should survive termination (including Sections 12, 14, 15, and 18) shall do so.
17. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will notify you by updating the "Last updated" date at the top of this page and, where appropriate, by sending an in-app notification or email. Changes take effect 14 days after notification.
Your continued use of the App after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the App and cancel any active subscription before the changes take effect.
18. Governing Law & Disputes
These Terms are governed by and construed in accordance with the laws of England and Wales. You and we both agree to submit to the exclusive jurisdiction of the courts of England and Wales to resolve any dispute or claim arising from these Terms or the App.
If you are a consumer resident in the EU, you may also benefit from the mandatory provisions of the consumer protection laws of your country of residence, and you may use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
Nothing in this clause affects your rights under applicable mandatory consumer protection law.
